Notice of motion.

Mr. Bhupinder Beniwal, AAG, Punjab, Punjab waives service of notice on behalf of respondent-State. 3.

Reply/status report be filed.

4. Since, the co-petitioner No.2 has been arrested, and therefore the present petition, insofar it appertains to the copetitioner No.2, is rendered infructuous, and, is disposed of, as such.

In the meantime, till further orders, in the event of the arrest of co-petitioners Nos. 1 and 3, by the arresting Officer, the latter shall release them, subject to theirs furnishing personal and surety bonds in the sum of ₹50,000/- each, to the satisfaction of the arresting Officer, and, also subject to theirs rendering co-operation to him, in DEEPAK KUMAR 2022.08.23 04:39 I attest to the accuracy and integrity of this document

Today, Ld. State Counsel on instructions from ASI Hamir Singh submits that though the petitioners have joined investigation but the wheat which was illegally harvested is yet to be recovered. 3.

Keeping in view the nature of allegations and the fact that the petitioners have already joined investigation, the order dated 2nd of April, 2022 is made absolute, subject to the conditions as enumerated under Sections 438(2) Cr.P.C.

The petitions stands disposed off.
