Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.51 dated 23.05.2015 under Sections 498-A and 406 IPC, registered at Police Station Phase-XI, District SAS Nagar, Mohali.

Notice of motion was issued and learned State counsel as well as learned counsel for respondent No.2-complainant appeared and contested the petition.

CRM No.M-20586 of 2015 -2in-law of the complainant-respondent No.2. Sukhpreet Singh Anand, son of the petitioners, is settled in USA. The complainant, after solemnization of the marriage on 16.11.2014, also boarded the flight for USA on 15.12.2014. It is the case of the petitioners that there was no problem till then. The matrimonial dispute arose when the complainant and her husband were residing in USA. It is also the case of the petitioners that it was a simple marriage and no dowry articles were taken at the time of marriage.

The petitioners have already joined the investigation. They are not required for custodial interrogation. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioners are entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 25.06.2015 granting interim bail to the petitioners is made absolute.
