R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 02 dated 04.01.2013 for offences under Sections 420, 465, 467, 468, 471 and 120-B of Indian Penal Code (IPC), registered at Police Station City Hoshiarpur, District Hoshiarpur. Heard.

The allegation in the FIR is that the document i.e. power of attorney was forged and the amount was received by Harnek Singh co-accused who has been declared a proclaimed offender on 10.12.2014.

Learned State counsel on instructions from ASI Sanjeev Kumar submits that out of 5 accused persons 3 have since been declared proclaimed offenders. It is further submitted that name of the petitioner appears in supplementary statement of the complainant that on behalf of original owners the fake power of attorney was prepared by Rakesh Kumar himself in his favour and later on that power of attorney was prepared by Rakesh Kumar in the name of Harnek Singh. CRM-M-20593 of 2015 -2against petitioner is that this was done in connivance with the petitioner.

The petitioner is in custody since 13.03.2015 and it will take long time in conclusion of the trial. The challan has already been presented on 16.05.2015.

In view of the above and without commenting on the merits of the case, the instant petition is allowed and the petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
