(Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.238 dated 30.7.2017 registered under Sections 323, 341 379-B IPC at Police Station Jagraon, District Ludhiana. The counsel for the petitioner contends that the petitioner has been falsely implicated in this case. The counsel for the petitioner further contends that no specific allegations are there in the FIR against the petitioner, who is in custody since 29.11.2021 and is no longer required by the police as challan has been presented in the Court concerned. The counsel further contends that similarly situated co-accused Kaku has already GAURAV SOROT 2022.07.08 17:44 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-14222-2022 been granted regular bail by this Court vide order dated 10.1.2022 (Annexure P-3).

The present petition is contested by the State counsel, who submitted that the petitioner was named in the FIR, which was registered against him and other two persons on the basis of statement of complainant Gurpreet Singh with regard to snatching of his motorcycle. However, the State counsel has not refuted the fact regarding grant of bail to co-accused Kaku by this Court.

I have considered the submissions made by counsel for the petitioner as well as by State counsel.

The petitioner was arrested in this case on 29.11.2021 and on completion of investigation challan was presented in the Court. It will take time for trial to conclude, further similarly situated co-accused Kaku has been granted regular bail by this Court vide order dated 10.1.2022. So no fruitful purpose is going to be served even if the petitioner is kept in judicial custody for indefinite period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
