The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

Mr. H.S.Randhawa, Advocate, inter alia contends that petitioner was issued passport on 23.03.2006 which was valid upto 22.03.2016. He was embroiled in FIR No. 38 dated 09.06.2007, under Sections 302, 307, 201, 506, 323, 148, 149 of IPC and Section 25, 54, 59 of the Arms Act, 1989. He was convicted by trial court and awarded sentence of seven years imprisonment. He has filed appeal before this Court which stands admitted. CWP No. 6174 of 2024 -2- 2024:PHHC:045235 He submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391.

Mr. Rahul Verma, Central Government Counsel for Union of India submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within eight weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 30.04.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within eight weeks from 30.04.2024.
