The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus upon respondent Nos.1 to 5, directing the respondents to reinstate the petitioner in service in view of the order dated 14.09.2023 passed by this Court. 2.
Learned Senior counsel submits that the petitioner, though was convicted by the Court of Sessions, however, this Court in CRR-2116-2018, has stayed the conviction as also suspended the sentence vide order dated 14.09.2023, Annexure P-2 by observing that the petitioner is to retire on 31.03.2024 and his conviction would come in his way of the service career/retiral benefits that he may be entilted to. In this regard, a representation dated 09.02.2024, Annexure P-7, has been submitted by him, which has yet not evoked any response. He thus prays for direction to decide the same by the respondents in a time bound manner. 3.
