Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Paramjit Singh, who has been booked for having committed the offences punishable under Sections 120-B and 409, IPC, in a case arising out of FIR No.344, dated 19.12.2014, registered at Police Station, Patti, District Tarn Taran.
At the very outset, learned counsel for the State, on instructions from ASI Panna Lal, Police Station, Patti, District Tarn Taran, very fairly concedes that during departmental inquiry, the petitioner has been declared innocent and that in the interrogation by the Investigating Agency, it has emerged on record that the amount, granted to the Gram Panchayat for development work, was spent before the petitioner joined as SEEMA RANI 2015.08.14 17:24
Criminal Misc.No.M-20644 of 2015 [2] Village Development Officer. He further submits that the petitioner has joined the investigation and his custodial interrogation is not required.
In view of the above, the present petition is allowed. Interim directions issued by this Court vide order dated 07.07.2015 are made absolute.
The petitioner shall continue to join the investigation as and when required to do so and shall abide by all the terms and conditions as laid down under Section 438(2), Cr.P.C. August 14, 2015 (Naresh Kumar Sanghi) seema Judge
