Petitioners have filed the present petition under Articles 226/227 of the Constitution of India, for issuance of a writ in the nature of Mandamus, directing respondent No.2 to consider petitioners No.1 and 2 for promotion to the post of Assistant, w.e.f. 11.11.2009 instead of 27.01.2015, and to promote petitioner No.3 to the post of Assistant w.e.f. 18.10.2011 instead of 25.04.2016.
A further prayer has been made by petitioners to decide legal notice dated 02.11.2023 (Annexure P-5).

At the outset, learned counsel for the petitioners submits that as regards the relief claimed in the present writ petition, the petitioners have served a legal notice dated 02.11.2023 (Annexure P-5) upon respondents No.1 and 2, however, the same has not been decided till date. It is submitted that the petitioners would be satisfied at this stage, if a direction is issued to respondent No.2 to consider/decide the aforesaid legal notice dated 02.11.2023 (Annexure P-5), in a time bound manner. At the asking of Court, Mr. Harish Nain, Assistant Advocate General, Haryana accepts notice on behalf of the respondent/State and submits that in case, the aforesaid legal notice dated 02.11.2023 (Annexure P-5) has been served and received in the concerned Office then the same shall be looked into/decided, in accordance with law, by the concerned authority and an appropriate speaking order will be passed. 5.
I have heard learned counsel for the parties and perused the paper book with their able assistance.

Since the petitioners claim to have served a legal notice dated 02.11.2023 (Annexure P-5) upon the concerned authority, accordingly, without commenting anything on the merits of the case, I deem it appropriate to dispose of the instant writ petition by directing respondent No.2, i.e. Director General, Animal Husbandry and Dairying Department, Haryana Pashudhan Bhawan, Bays No.9-12, Sector-2, Panchkkula, to look into, consider and decide the aforesaid legal notice 02.11.2023 (Annexure P-5) by passing a speaking order within a period of eight weeks from the date of receipt of the certified copy of this order. It goes without saying that in case, the petitioners are entitled to any relief, the same be granted to them, in accordance with law.

Present petition is disposed of in the aforesaid terms. 8.
