CRM No.19574 of 2016 Application is allowed as prayed for.

Main Case 1.

This petition has been preferred under Section 438 Cr.P.C. for grant of pre-arrest bail in case FIR No.141, dated April 03, 2016, under Sections 406, 420, 467, 468, 471 & 120-B of IPC, registered at Police Station Pehowa, District Kurukshetra.

On June 22, 2016, while issuing notice of motion, the following order was passed:

[2] "Learned counsel for the petitioner has contended that co-accused namely Manjit Singh of present petitioner has been granted the benefit of anticipatory bail vide order dated 20.5.2016 (Annexure P-5) passed in CRM-M-17980 of 2016 which is now fixed for 17.8.2016. It is also contended that the case of the petitioner is on the same footing as that of Manjit Singh. Notice of motion.

At the asking of the Court, Mr.Indresh Goel, Additional Advocate General, Haryana, accepts notice on behalf of the respondent-State.

Adjourned to 17.8.2016 In the meanwhile, petitioner is directed to join investigation in this case within seven days from today and in that event, the petitioner be admitted to bail on his furnishing requisite bail bonds and surety bonds to the satisfaction of Investigating Officer / Station House Officer concerned. The petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C. To be heard with CRM-M-17980 of 2016."

Learned State counsel has submitted that the petitioner(s) has joined the investigation and is not required for further interrogation. 4.

From the contents of petition, it is evident that civil litigation is pending between the parties and the Civil Court is seized of the matter. Moreover, co-accused of petitioner namely Manjit Singh has also been granted the concession of interim bail by this court vide order dated September 16, 2016 passed in Criminal Miscellaneous No.M-17980 of 2016.

Taking into consideration the above facts of the case, the
