The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 21.11.2023 (Annexure P-8) whereby his application seeking correction of date of birth in the passport has been rejected.

The petitioner claims that his correct date of birth is 05.06.1969 and in the earlier passport, it has wrongly been recorded as 15.02.1976. Similarly, there is mistake in the spellings of his name. The petitioner applied for re-issuance of passport with correct name and date of birth, however, respondent vide order dated 21.11.2023 rejected his application. 3.

Faced with this, Mr. Pushp Jain, Advocate, seeks permission to withdraw the instant petition with liberty to petitioner to file appeal before appellate authority.

Dismissed as withdrawn with liberty to the petitioner to prefer appeal before appellate authority. If he files appeal, within two weeks from today, the same would be decided on merits by appellate authority.
