Petitioner is facing trial in a case registered against him under sections 379 IPC and 4(1) of the Mining and Mineral Act, 1957 vide FIR No. 260 dated 09.12.2013 at Police Station Kurali, district SAS Nagar.

He seeks concession of pre-arrest bail as his bail bonds were cancelled and surety bonds forfeited. According to learned counsel, petitioner could not appear before the trial court on 25.09.2014 as he had gone to Gauhati, being a truck driver. According to learned counsel, petitioner is ready to furnish an undertaking before the court that he shall not absent from the court proceedings on any date in future.

Learned State counsel has opposed the prayer. According to her, P.O. proceedings are also pending against the petitioner.
