IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH

Sr. No.: 121 Criminal Revision (F) No.405 of 2023 Date of Decision: March 20, 2023 Piyush Goyal ..... PETITIONER(S)

VERSUS

Sonali Goyal ..... RESPONDENT(S) . . .

CORAM:

HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA . . .

PRESENT: - Mr. M.K. Mittal, Advocate, for the petitioner. . . .

Tribhuvan Dahiya, J (Oral) This revision petition has been filed against the order dated 21.01.2023, whereby interim maintenance of ` 20,000 has been awarded to the respondent-wife.

Admittedly, the petitioner's monthly income, as per his affidavit of assets and liabilities, dated 23.09.2022 (Annexure P-3), is ` 53,000 approximately.

Learned counsel for the petitioner has contended that the awarded interim maintenance is on a higher side as the petitioner has other liabilities to meet, like that of monthly loan instalments and maintaining his aged parents.

The petitioner's liabilities and the expenses he has to incur to meet the same, is a matter of trial. As the facts stand today, his monthly income is ` 53,000 approximately, and the respondent-wife is not earning anything.

2023:PHHC:040180 CRR(F) No.405 of 2023 [2] Keeping these facts in mind, the interim maintenance awarded by the Family Court cannot be said to be on a higher side. Therefore, there is no ground to entertain the petition. Dismissed.

Since the main petition stands decided, all pending applications, if any, are disposed of as having been rendered infructuous. (Tribhuvan Dahiya) Judge March 20, 2023 avin Whether Speaking/ Reasoned:
