******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 142 dated 07.08.2012 registered for the offence punishable under Section 506 of Indian Penal Code at Police Station Sector-40, District Gurgaon.

Heard.

Learned counsel for the petitioner submits that the petitioner has surrendered before the trial Court and has been released on bail as per order dated 02.06.2017.

Learned State counsel under instructions from ASI Naresh Kumar also submits that the petitioner has put in appearance before the trial Court.

CRM-M-20793-2017 -2As the petitioner has appeared before the trial Court and released on interim bail, this petition is allowed and the order dated 02.06.2017 is made absolute subject to the condition that petitioner shall keep on appearing before the trial Court on each and every date of hearing. In the event of his non-appearance on any date, the trial Court will be competent to cancel his bail, forfeit the bail bond and surety bond and the petitioner may be taken into custody.
