*** ARUN MONGA, J. (ORAL) Petition herein inter alia is for issuance of a writ in the nature of mandamus directing the respondents to consider the claim of the petitioners for promotion as Clerk from the date when their juniors have been promoted. Learned counsel for the petitioners submits that petitioners are eligible for promotion on the post of clerk as per the Haryana Excise and Taxation Commissioner Office (Group-C) Service Rules, 1980. He submits that similarly situated employee earlier approached this Court vide CWP No. 20844-2015, which was allowed on 28.01.2022 (Annexure P-2). He submits that petitioner qua his aforesaid grievance submitted a legal notice dated 01.03.2022 (Annexure P-3) but to no avail. Hence, the instant petition. On advance service, learned State counsel appears and on a court query submits that case of the petitioners is indeed squarely covered by the order dated 28.01.2022 contained at Annexure P-2. I have heard learned counsel for the petitioner and gone through the case file.
