CRM-M-21743-2018 The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.77 dated 16.06.2014 registered for the offences punishable under Section 3 of The Prevention of Damage to Public Property Act, 1984, at Police Station Moonak.

Petitioner had absented from the trial Court. Vide order dated 21.05.2018, he was directed to surrender and was ordered to be released on furnishing bail bond and surety bond to the satisfaction of trial Court. He was also burdened with costs of `20,000/- to be deposited with District Legal Services Authority, Sangrur.
Learned counsel for the petitioner submits that the petitioner could not appear in the trial Court on 10.08.2017 and subsequent dates due to illness of his mother. He moved application for exemption from his personal appearance which was declined. Now, the petitioner has surrendered before the trial Court and has been released on bail. He has also deposited costs of `20,000/- with District Legal Services Authority. Keeping in view the above facts but without expressing any opinion on the merits of the case, this petition is allowed and order dated 21.05.2018, allowing bail to the petitioner on furnishing bail bond and surety bond to the satisfaction of trial Court, is made absolute, subject to the following terms:- (i) that the petitioner shall keep on appearing before trial Court regularly;
(ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave India without the prior permission of the Court;
