Mr. Sohail Qasim Mir, Senior Superintendent of Police (Rural), Amritsar and Mr. Rajiv Arora, Superintendent, Central Jail, Amritsar have appeared in person.

The Senior Superintendent of Police (Rural), Amritsar, has filed an affidavit. The same be taken on record.

The Superintendent, Central Jail, Amritsar has stated that the petitioner could not be produced before the learned trial Court, because on several occasions the requisite police guard was not provided by the police authorities.

In response to above-mentioned statement, the Senior Superintendent (Rural), Amritsar has stated that there was some difficulty with the mechanism meant for providing police guard, and that now a new DEEPAK KUMAR BHARDWAJ 2026.04.20 18:25 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-11559 of 2026 mechanism has been devised in order to check re-occurrence of such lapses. It has been assured by the Senior Superintendent (Rural), Amritsar that there will be no difficulty, in future, in providing police guard to the jail authorities for the production of undertrial before the trial Court. 5.

In view of above-mentioned assurance, personal appearance of the Senior Superintendent (Rural), Amritsar and the Superintendent, Central Jail, Amritsar is hereby dispensed with, henceforth. 6.

At this stage, learned counsel for the petitioner has submitted that he wants to withdraw the present petition with liberty to file fresh petition in case the trial is not concluded by 15.08.2026. 7.

In view of above-mentioned statement of learned counsel for the petitioner, the present petition is hereby dismissed as withdrawn with liberty aforesaid.
