******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 117 dated 28.11.2015 registered for the offences punishable under Sections 307, 506, 148 read with Section 149 of Indian Penal Code and 25, 27 of Arms Act at Police Station Ajitwal, District Moga. Heard.

Learned counsel for the petitioner has placed on file, copy of order dated 13.07.2017 passed by Additional Sessions Judge, Moga which states that the petitioner had surrendered before the trial Court and was released on interim bail on 14.06.2017. Initially, the petitioner was found innocent and now he has been summoned by the trial Court on the application of the prosecution under Section 319 Cr.P.C. CRM-M-20851-2017 -2Keeping in view the fact that the petitioner has put in appearance before the trial Court and the case is still pending for summoning of other accused, this petition is allowed and the order dated 02.06.2017 is made absolute subject to the condition that petitioner will keep on appearing before the trial Court on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
