The petitioner apprehending arrest in the FIR No.141 dated 19.9.2021 under Section 22(c)/29/61/85 NDPS Act has come up before this Court under Section 438 CrPC seeking anticipatory bail.

Learned counsel for the petitioner submits that the only evidence against the petitioner is the confession of the co-accused and there is no evidence against the petitioner to connect him in the present case. 3.

On the contrary, learned State counsel submits that initially, the petitioner was granted interim bail till filing of the FSL report. However, on filing of the FSL report and quantity of the alleged contraband has been found to be commercial. 4.

Given above, the present petition is not maintainable and petitioner to surrender before the trial Court and file a fresh petition for regular bail. 5.

At this stage, learned counsel for the petitioner seeks to withdraw the present petition.

Accordingly, the present petition is disposed of, having been withdrawn. However, it is clarified that withdrawal of the present petition shall not come in the way of the petitioner while filing any other petition, but it is subject to the condition that ASHWANI KUMAR 2022.04.22 08:31 I attest to the accuracy and integrity of this document
