HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Maninder Singh Bajwa, Advocate for the petitioner. *** The case has been taken up through Video Conferencing. Petitioner accused Amarbir Singh @ Gopi Mahal was granted regular bail in case F.I.R No. 99 dated 1.11.2015 under Sections 307, 506, 379, 411, 34 IPC and Section 25 of the Arms Act registered with Police Station Ghuman, District Gurdaspur. The trial against him was going on. On account of his absence from the trial Court his bail bonds were cancelled and fortified to the State and he was ordered to be summoned through nonbailable warrants of arrest vide order dated 4.12.2018. Subsequently, since it transpired that he was in custody in some other criminal case, his presence was procured by way of issuing the production warrants.

He had moved an application for grant of regular bail which was accepted by this Court vide order dated 16.7.2020, however, he again absented from the Court and his warrants of arrest have been issued. According to the petitioner his mother was notified about the date of hearing but she could not inform him as she is an illiterate lady and on account of trauma also as she had lost her other son. The petitioner instead of surrendering in the trial Court had chosen to file PARVINDER SINGH 2021.04.

CRM-M-15008 of 2021 petition for pre-arrest bail which was dismissed by the Court below. Now he has knocked at the door of this Court craving for grant of similar relief. Obviously, the petitioner is an absconder and does not deserve concession of anticipatory bail. Therefore, the petition is dismissed accordingly. The petitioner is directed to surrender in the trial Court within 7 days. On his doing so and moving application for regular bail, the same be decided by the trial Court expeditiously.
