Learned counsel appearing for the respondents states that the ground for rejection was that the petitioner was the married younger brother of the deceased and thus did not fall within the policy, to which there was rebuttal by filing any replication.

In view of the above, the present petition is disposed of, reserving the petitioner with a liberty to get it revived, in case lis still subsists.
