Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of bail to the petitioner, Sukhwinder Singh, who has been booked for having committed the offences punishable under Sections 120-B, 420, 465, 467, 468, 471 and 511, IPC, in a case arising out of FIR No.18, dated 06.03.2015, registered at Police Station, City Jalalabad, District Fazilka. Learned counsel contends that all the offences for which the petitioner has been booked are triable by learned Judicial Magistrate Ist Class; after completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has been presented; the amount alleged to have been transferred in the fictitious bank accounts allegedly opened by SEEMA RANI 2015.09.11 16:03 I attest the accuracy and authencity of the document
Criminal Misc.No.M-20877 of 2015 [2] the petitioner, has been restored to its real claimants; and that the petitioner, who is neither required nor involved in any other case, is behind the bars from 07.03.2015.
Learned counsel for the State, after taking instructions from SI Lekh Raj, Police Station, City, Jalalabad, District Fazilka, has not controverted the above factual position explained by learned counsel for the petitioner.
Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Sukhwinder Singh, s/o Ranjha Singh, r/o village Patli Dabar, Tehsil and District Sirsa, now confined in Central Jail, Ferozepur, is directed to be released on bail during pendency of trial of the present case subject to his furnishing bail bond to the satisfaction of learned trial Court.
