This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 9 dated 18.01.2012 under Sections 399, 402, 467, 468, 489, 471 & 120-B IPC and section 25/54/59 of the Arms Act at Police Station Passiana, district Patiala.
Admittedly, petitioner absconded during the pendency of trial. He surrendered after a period of five months. According to learned State counsel, out of 32 witnesses cited by the prosecution only four have been examined till now. Besides, petitioner is involved in five other cases.
Under the circumstances, no case for grant of bail is made out at this stage. Dismissed.
Petitioner shall, however, be at liberty to file afresh after material witnesses have been examined.
