R.P. Nagrath, J. (Oral) Prayer in the instant petition is for grant of anticipatory bail under Section 438 Cr.P.C. in FIR No. 196 dated 21.10.2014 for offences under Section 382 of Indian Penal Code (IPC), registered at Police Station Sultanpur Lodhi, District Kapurthala.
Learned counsel for the petitioner mainly relies upon assertions made by the complainant and the other witness in their affidavits (Annexures P-2 and P-3) wherein they have stated that the petitioner was not one of the miscreant. Learned State counsel submits that correctness of these affidavits (Annexures P-2 and P-3) has been verified. It is, however, submitted that the petitioner has not joined the investigation.
The petitioner is directed to appear before the Arresting Officer/SHO of the Police Station on 28.08.2015 between 11.00 a.m. to 02.00 p.m. The petitioner is also directed to keep on joining the investigation as and when required and JITENDER KUMAR 2015.08.20 17:36 I attest to the accuracy and integrity of this document

In case, petitioner fails to appear before the Investigating Officer on the date stipulated above, the concession granted to him vide this order shall stand vacated.
With the aforesaid condition, the interim bail granted vide order dated 08.07.2015, is made absolute. Allowed in the above terms.
