Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.270 dated 01.04.2016 under Sections 420, 467, 468, 471 IPC and Section 61 of the Excise Act registered at Police Station Sadar Karnal, District Karnal.

Notice of motion.

Mr.Baljinder Singh Virk, Deputy Advocate General, Haryana, who is present in the Court, on the asking of the Court, accepted notice on behalf of the respondent-State and contested the petition. Police record is also available.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the main allegation against the present petitioner is that he was carrying liquor in the truck and was having forged bilty and bill etc.

CRM No.M-21836 of 2016 -2The challan has already been presented. The charges have already been framed. The offences are triable by Judicial Magistrate. The petitioner is no more required for interrogation or investigation purposes. He is in custody since 01.04.2016. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
