Versus

STATE OF HARYANA AND OTHERS . . . Respondent(s) CORAM: HON'BLE MS. JUSTICE KIRTI SINGH PRESENT: Mr. Aazam Khan, Advocate for the petitioners.

Mr. Brijesh Sharma, AAG, Haryana.

**** KIRTI SINGH, J. (Oral) By way of instant petition, petitioners have approached this Court for issuance of directions to respondents No.2 and 3 for protection of their life and liberty at the hands of private respondents No. 4 to 9. 2.

Learned counsel for the petitioners submits that petitioners are happily residing together and now there is no threat perception to them at the hands of private respondents No.4 to 9.

3.

Learned State counsel while referring to the status report dated 22.04.2024 already filed by the State on behalf of respondents No.1 to 3, refers to Paragraph No.5 of the same, which says as under : "5.

That the police tried his best to contact the petitioners and to record their statements but no contact has been made out with the petitioners. The police also served notices to the father of the petitioner No. 1 namely Sahabuddin son of Sh. Chand Khan on 06.04.2024, 10.04.2024 and 16.04.2024 and the father of the petitioner No. 1 along with Sarpanch of village Singar, Block Punhana came and their statement have been recorded in which they have stated that the petitioners are residing in live-in-relationship with their free will and wish and there is no danger for the life and KAVITA NAIN 2024.07.16 17:05 I attest to the accuracy and integrity of this document order/judgment

CRWP-2412-2024 - 2 - liberty of the petitioners. It is important to mention here that the petitioner no. 2 is minor as her date of birth is 22.12.2008 as per school certificate. There is no danger to the life and liberty of the petitioners from the hands of the respondents No. 4 to 8. The respondents No. 4 to 8 also stated in their statements that they neither create any threat to the petitioners nor create any danger for the life and liberty of the petitioners in any manner. The investigation agency will provide protection to the life and liberty of the petitioners if they have to require in future and therefore in view of above mentioned facts, the present petition is not maintainable and liable to be dismissed. The translated copy of statement of father of the petitioner No. 1 and Sarpanch of village Singar, Block Punhana are attached herewith as annexure R-8 & R-9." 4.

Be that as it may, this Court itself has gone through the reply filed by the State and has noticed that due attention and care has been given to the grouse of the petitioners and an assurance for providing the police protection as and when need arises has also been detailed in the status report. 5.

Believing the stand of the State as taken in the status report, I am of the view that no issue is left for this Court to entertain the prayer made in the petition regarding providing protection to the lives and liberty of the petitioners.

6.

Thus, in view of the observations made hereinabove, present petition stands disposed of as infructuous.
