"#  $ The application under Section 340 Cr.P.C. was initially filed on 19.03.2012 in which evidence of the two sides was closed on 18.05.2013 and thereafter on ten dates the matter has been adjourned for consideration of the application for one reason or the other, which apparently reflects that there has been non3application of mind by the concerned Court and has dithered with the decision for the reasons best known to it.
