Present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner.

Allegations against the petitioner are that while posted as Clerk, in the office of District Transport Officer, Mansa, combined Harvesters were registered, which were not of the same area. It was been done by petitioner-Sahil Bagga in connivance with District Transport Officer Karanvir Singh Chhina and Kulwinder Singh, who was working as agent, by taking bribe. No certificate was issued by State Transport Commissioner, Punjab, Chandigarh, in respect of those combined and the same were also passed by Motor Vehicle Inspector. In some of the cases, the purchasers were residents of District Mansa and fake copies of their ration cards were attached.

Learned counsel for the petitioner mainly took the plea that petitioner, who was working as Clerk in the office of District Transport Officer, Mansa, dealt with some files qua which forged numbers were issued by the District Transport officer. Petitioner was neither issuing authority nor the verifying authority. There is not even a single statement against the petitioner that he had ever received any money from any person or that he had any role to play in the entire episode. Otherwise petitioner is in custody since 15.05.2015 and nothing is to be recovered from him. So, he be released on bail.

Learned State counsel opposed the bail application. 5.
Without expressing anything on merits of the case and keeping in view the fact that the petitioner was the main dealing official, posted as Clerk, in the Office of District Transport Officer, Mansa, at the relevant time and in connivance with District Transport Officer, Mansa and agent for the purpose of registered combined Harvesters of residents beyond their jurisdiction by accepting bribe. Allegations against the petitioner are of serious nature and requires detailed investigation and at present investigation is going on. Therefore, he is not entitled to the concession of regular bail.

Accordingly, the regular bail application filed by the petitioner is hereby dismissed.
