Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 144 dated 24.9.2014 under Section 420, 465, 467, 468, 471, 120-B, 511 of the Indian Penal Code, 1860, registered at Police Station City Jalalabad, District Fazilka.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 11.1.2015. Co-accused of the petitioner are on bail. Challan has been presented in the Court and conclusion of trial may take time. Learned counsel has further submitted that the loan in question had not been released by the bank.

Learned State counsel, on the other hand, has opposed the petition.

However, before the loan could be advanced, the bank manager suspected foul play and the FIR in question was registered. Keeping in view the fact that the petitioner is in custody since 11.1.2015 and the other co-accused of the petitioner are on bail, without expressing any opinion on the merits of the case, this petition is allowed.
