**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 5 dated 8.1.2018 registered at Police Station Bagha Purana, District Moga under Sections 376, 506 IPC and Section 67 of I.T. Act. Counsel for the petitioner contends that petitioner is in custody over 11 months and the trial will take time. Counsel further submits that the prosecutrix is married and she has already been examined by the trial Court and Balraj Kaur has not supported at the trial. Counsel further contends that mobile from which the photographs are said to have been sent, was not owned by the petitioner.
State counsel submits that the mobile from which the obscene photographs of the prosecutrix were sent had been recovered from the petitioner and though the SIM was in the name of Balraj Kaur but in the initial statement made to the police, Balraj had stated that the petitioner had taken the phone from her. State counsel further submits that recovery of the phone was effected from the petitioner. The prosecutrix is a married lady. The obscene photographs of the prosecutrix were sent by the petitioner to her husband. In her statement she had stated that the petitioner was blackmailing her and when she failed to succumb, he sent the photographs to her husband. Considering the above, I am not inclined to grant bail. The petition is dismissed.
