The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 02.01.2026 whereby respondent No.2-Registrar, Firms and Societies, Chandigarh has ordered to conduct fresh election; and order dated 02.02.2026 whereby review application has been dismissed without granting opportunity of hearing.

Term of Executive Committee of Aggarwal Sabha, Ambala Cantt. expired and District Registrar vide letter dated 28.04.2021 appointed an adhoc committee comprising 7 members. The adhoc committee on 23.04.2025 decided that each collegium will consist 29/30 members and society shall maintain membership register. The society on

-224.04.2025 applied for approval of District Registrar. The District Registrar in compliance of orders of Deputy Commissioner, Ambala appointed SDM, Ambala as Administrator of the society. The District Registrar vide letter dated 11.07.2025 informed State Registrar about constitution of collegium. The State Registrar vide letter dated 14.10.2025 granted approval for constitution of collegiums. The election process started and this fact was published in newspapers. There were 78 candidates as per list dated 13.12.2025. Date to withdraw was 15.12.2025 and 11 candidates withdrew their forms. Out of 50 collegiums, 32 members of different collegiums were appointed unopposed and election of remaining collegiums remained pending. Umesh Gupta and 2-3 other members on 23.12.2024 filed appeal before Registrar General.

The Registrar General vide order dated 02.01.2026 decided Umesh Gupta's application without granting opportunity to petitioner and other members. The Registrar ordered to conduct fresh elections. The petitioner preferred review application before Registrar General who without granting opportunity of hearing dismissed the same vide order dated 02.02.2022. 3.

Learned counsel for the petitioner submits that without commenting on merits, the petition may be disposed of, with a direction to Registrar General to grant him opportunity of hearing and pass fresh order.

Learned counsel for the respondent No.7 as well as learned State counsel submit that they have no objection if impugned orders are set aside and a fresh order is passed after granting opportunity of hearing, however, in the meantime elections may not be conducted.

In the wake of statement of both sides, the petition stands disposed of. The impugned orders dated 02.01.2026 (Annexure P-14) and 02.02.02026 (Annexure P-16) are hereby set aside with a direction to Registrar General to pass a fresh order after granting opportunity of hearing to petitioner as well as respondent No.7. It would be appropriate if Registrar General passes fresh order within four weeks from today. It is made clear that till the passing of fresh order, elections of the Sabha would not be conducted.
