M.M.S. BEDI, J. (ORAL) Application under Section 311 Cr.P.C., for tendering revenue record of the years 2008 to 2014, in a private complaint has been dismissed vide impugned order.
Relevant facts required for the adjudication of present case are that the petitioner has filed a complaint against the respondents alleging that on 9.11.2018, the respondents constituted an unlawful assembly armed with different weapons and tried to forcibly occupy khasra No.10 measuring 8 kanals and inflicted injuries on the person of the complainant with their weapons. On asking of the Court, counsel for the petitioner informs that the case is at the stage of arguments. I have heard the counsel for the petitioner and gone
CRM-M-21068-2015 (O&M) through the application under Section 311 Cr.P.C., Annexure P3 filed by the petitioner. It is apparent that no prayer has been made for summoning or resummoning any witness, as such, the provisions of Section 311 Cr.P.C., are not attracted for production of documents. Taking into consideration the stage of the case, I do not deem it appropriate to interfere in the impugned order passed at penultimate stage of the case.
The petition is dismissed without prejudice to the other rights of the petitioner.
