*** GURBIR SINGH , J. (ORAL) On 14.03.2023, following order was passed:
"The present petition has been filed under Article 226 of the Constitution of India for issuance of writ in the nature of Habeas Corpus, appointing a Warrant Officer to locate the detenue-Sukhwinder Singh S/o Kabal Singh and to get him released from the illegal custody of officials working under the supervision of respondents No.2 to 4 or from the Johal Hospital, Jalandhar or any place as disclosed by the petitioner. As per version of the learned counsel for the petitioner, detenue is detained by respondents No.2 to 4 in a room in Johal Hospital, Jalandhar under the pressure of the Aam Admi party and petitioner is not allowed to meet her husband-detenue.
Notice of motion.
At the asking of the Court, Ms. Himani Arora, AAG, Punjab, accepts notice on behalf of respondentsState. A copy of the paper book be supplied to her during the course of the day.
To come up on 16.03.2023.
Learned State counsel is directed to file the reply positively on the date fixed. If reply is not filed then some Gazetted Officer Supervising the Police Station, Tanda, Hoshiarpur shall appear in person in the Court." Short Reply dated 16.03.2023 by way of an affidavit of Kulwant Singh, PPS, Deputy Superintendent of Police, Sub Division Tanda, District KUSUM 2023.03.22 10:17 I attest to the accuracy and authenticity of this order/judgment Punjab & Haryana High Court, CHD Hoshiarpur on behalf of respondent No.1, 3 and 4 has been filed today in the
2023:PHHC:041629 CRWP-2488-2023 -2Court and the same is taken on record. A copy thereof has been supplied to the counsel opposite.
As per said reply, Para No.8 is reproduced below for reference:- "It is submitted that the Police of P.S. Tanda, District Hoshiarpur never detained illegaly Sukhwinder Singh @ Vicky husband of the petitioner and Sukhwinder Singh @ Vicky husband of the petitioner was arrested on 15.03.2023 in above said main FIR got registered by complainant Paramjit Singh. Sukhwinder Singh @ Vicky husband of the petitioner remained under treatment from 06.03.2023 to 15.03.2023 in Johal Hospital, Jalandhar and he was discharged on 15.03.2023 by the doctor of Johal Hospital, Jalandhar and then he was arrested in the present main FIR on 15.03.2023."
At the outset, learned counsel for the petitioner wants to withdraw the present petition.
Since detenue has already been arrested in the main FIR No.71, no further order is required to be passed by this Court. This petition is disposed of accordingly.
