Learned counsel for the petitioners submits that as per order dated 26.02.2020 passed in CWP No. 5096 of 2020, it was ordered that appointments in pursuance to the provisional select list, if already not made, shall not exceed 225 in the case of the male category. The respondents in violation of that order have issued appointments of 82 persons on different posts on 07.03.2020 and in this manner 380 appointments have been made from the male category.
Learned State counsel, who has put in appearance on behalf of the respondents submits that the persons mentioned in the list have joined in pursuance to the letter (Annexure P-2) on 20.02.2020 and they were sent for special Induction Training-cum-Residential Workshop from 21.02.2020 to JYOTI 2020.03.19 13:16 I attest to the accuracy and integrity of this document
COCP-992-2020 08.03.2020. The Secretary to Government of Punjab, Department of School Education has allowed the fresh appointee to join their duties immediately without production of a medical certificate of health. In this regard, he has filed copy of order dated 20.02.2020 passed by the Secretary to Government of Punjab, Department of School Education, which is taken on record. Annexure P-3 is the order of posting of certain persons and it is not an appointment letter. It is specifically mentioned that their appointment letters of persons who were given posting orders were separately issued. While forwarding the copy of their posting order (P-3) to District Education Officer (S.E.), Fazilka, copy of their appointment letters of the selected candidates was also enclosed.
In view of the submission of learned State counsel, I am of the opinion that order dated 26.02.2020 has not been violated as alleged by learned counsel for the petitioners calling for any action to be taken against the respondents under Section 10 and 12 of Contempt of Courts Act. This petition has no merits.
Dismissed.
