***** ARUN MONGA, J. (ORAL) Petition herein has been filed by landlady seeking direction to learned Rent Controller, Malerkotla to decide application/ rent petition bearing No.RP/51/2020 filed under Section 20(2)(a) of the Punjab Rent Act, 1995 for ejectment of respondents from shop in question, on merits in a time bound manner as petitioner is an old aged lady.

The revision petition is premised on the averments that petitionerlandlady filed a petition for ejectment of respondent-tenants from shop in question. On 18.11.2020, notice in the said petition was issued. Respondents filed their written statement on 16.09.2021. Thereafter, case is being adjourned from time to time.

Learned counsel for the petitioner would contend that ejectment petition before learned Rent Controller is being adjourned from time to time. Petitioner is a senior citizen aged about 67 years and matter is pending for the last three years. Respondents have not vacated the shop in question and petitioner is being deprived of using her own property.

Given the nature of order being passed, there is no necessity to issue notice to respondent-tenants, as no serious prejudice would be caused to them. Notice to respondents is thus dispensed with. 5.

I have heard learned counsel for petitioner and gone through the case file.

Ordinarily this Court would not have interfered merely because there is certain delay in disposing of the rent petition, given the fact that for a sufficiently long period, work in the Courts was suspended owing to intervening pandemic and even subsequent thereto, Courts were working under certain restrictions and it is only recently that full-fledged working of the Courts have resumed. However, given the allegations that on one hand respondent-tenants are not paying the rent and on the other hand, they are taking advantage of circumstances, as stated hereinabove, to continue to run their business depriving landlady-senior citizen of the rent, which is source of her survival.

In the premise, revision petition is disposed of with expectation from learned Court below that pending rent petition shall be disposed of expeditiously without granting unnecessary adjournments.
