******* SURINDER GUPTA, J.(Oral) The above mentioned petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No. 0064 dated 09.03.2015 registered for the offences punishable under Sections 302, 201, 109 read with Section 120-B of Indian Penal Code at Police Station Tripuri Town, District Patiala. Both the petitioners were summoned to face trial as additional accused on the application of prosecution under Section 319 Cr.P.C. Learned counsel for the petitioners submit that both the petitioners have appeared before the trial Court and have been released on interim bail.

Learned State counsel on instructions from ASI Karambir Singh also submits that both the petitioners have appeared before the trial Court and have been released on interim bail and charges have been framed against them.

Keeping in view the above facts, but without expressing any opinion on the merits of the case, both the petitions are allowed and the order dated 06.06.2017 passed in CRM-M-21195-2017 and order dated 16.06.2017 passed in CRM-M-22097-2017 are made absolute subject to the condition that petitioners shall appear before the trial Court on each and every date of hearing. In the event of their non-appearance on any date, the trial Court will be competent to cancel their bail and forfeit the bail bonds and surety bonds and to take the petitioners into custody.
