**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.71 dated 13.09.2019 registered under Sections 452, 323 IPC at Police Station Begowal, District Kapurthala.

Notice of motion was issued on 18.03.2020 on the premise that offence under Section 452 IPC is the only nonbailable offence incorporated in the FIR. Place of occurrence vis-a-vis complicity of the petitioner would remain debatable for the aforesaid offence. Petitioner stood as surety for the son of the complainant in a criminal case. Owing to some heated arguments between the parties, the occurrence took place, but not in the manner as suggested by the prosecution in the FIR. CRM-M No. 11368 of 2020 -2Learned State counsel on instructions from ASI Barjinder Singh submits the petitioner has joined the investigation on 09.04.2020, challan has been submitted on 09.05.2021 and now the case is fixed for 05.10.2021 for framing of charges.

With filing of challan, presence of the petitioner is not required for further investigation in the case. In view of above, order dated 18.03.2020 is hereby made absolute.

However, the petitioner shall keep on appearing before the trial Court regularly.

Disposed of.
