Mr. J.S. Rattu, Advocate, for the petitioner. Ms. Kusum Rani, Advocate, for Mr. ADS Jatana, Advocate, for respondent No.2.
Mr. Ravinder Singh, AAG, Punjab.
***** JASJIT SINGH BEDI, J. (Oral) The prayer in the present petition under Section 482 Cr.P.C. is for quashing of FIR No.107 dated 14.06.2015 under Sections 420, 467, 468, 471 IPC registered at Police Station Lalru and all consequential proceedings arising therefrom.
The learned counsel for the petitioner contends that the petitioner is the accused in the present FIR and a cancellation report has been submitted before the Trial Court on 10.01.2017. He submits that no order has been passed on the said cancellation report till date. He claims to be aggrieved by that fact as on account of the pendency of the FIR, the petitioner is unable to travel abroad.
The learned counsel for the State on the other hand submits that the cancellation report was prepared on 25.04.2017 and the same is pending adjudication before the Illaqa Magistrate and is now fixed for hearing 04.10.2022.
In view of the above, the present petition is disposed of with the directions to the Illaqa Magistrate to adjudicate upon the cancellation report within a period of four weeks from the next date fixed before it.
