**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.230 dated 15.12.2019 registered under Sections 323, 324,148,149,326 (added later on) IPC, at Police Station Kotwali, District Kapurthala. On 18.03.2020, following order was passed:- Learned counsel for the petitioner contends that in respect of occurrence dated 09.12.2019, the FIR came to be registered only on 15.12.2019. The injury punishable under Section 326 IPC is attributed to the co-accused Jasbir Singh @ Sheera who is alleged to have given 'Datar' blow on the right hand fingers of the complainant. Petitioner was shown present with a 'dang' but no specific attribution has been alleged against the petitioner.

Notice of motion for 15.04.2020.

In the meanwhile, petitioner is directed to appear before the SHO/Investigating Officer to join investigation on 23.03.2020 at 11.00 a.m. and in the event of his arrest, he shall be enlarged on ad interim bail, subject to his furnishing requisite AMANDEEP GOSAIN 2021.09.15 18:40 I attest to the accuracy and integrity of this document

CRM-M No.11366-2020 bail bonds/surety bonds to the satisfaction of Arresting Officer. However, petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

To be heard along with CRM-M No.6097 of 2020. Learned counsel for the petitioner submits that in compliance of the order dated 18.03.2020, petitioner has joined the investigation to the entire satisfaction of the Investigating Officer.

Learned State counsel on instructions from ASI Baldev Singh admits the aforesaid fact and submits that the petitioner is no more required for further investigation in the case. Even challan has been submitted to the trial Court. In view of aforesaid factual position, the interim order dated 18.03.2020 is made absolute. However, petitioner shall keep on appearing before the trial Court regularly. Petition stands disposed of.
