Present petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 419 dated 22.8.2013, registered under Section(s) 342, 323 & 395 IPC, at Police Station Sector 5, Panchkula.

Learned counsel for the petitioner contended that petitioner is in custody for a period over one year and he was not initially named in the FIR, Rather his name cropped up in the statement of co-accused and he has been falsely implicated in this case. The decision of the case still to take some more time. Thus, he be released on regular bail. Learned counsel for the respondent-State opposed the petition on the ground that previous conduct of the petitioner suggests that he was declared proclaimed offender and was arrested after a considerable delay Deepak Kumar Bhardwaj 2017.07.18 15:35 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-2124 of 2017 and if he is released on bail, he can again abscond and as such his petition for grant of regular bail be dismissed.

Having considered the submissions made by learned counsel for the parties; the fact that name of the petitioner was not initially disclosed in the first version; he is in custody for a period over one year as per custody certificate; decision of the case still to take some more time and no useful purpose shall be served by detaining him in custody any further, the present petition is accepted. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Panchkula.
