This second petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.969 dated 22.9.2015 registered for the offences under Sections 419, 420, 468, 471 and 120-B IPC at Police Station Jhajjar, District Jhajjar.

Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

Cr. Misc. No.M-22171 of 2016 [2] The offences are triable by the Judicial Magistrate Ist Class. The petitioner, who is in judicial custody, is no more required for any interrogation and investigation purposes. He is not the main accused. The only allegation against the petitioner is of fake ID. There is no other case pending against the present petitioner as argued. The petitioner is in judicial custody since 23.9.2015. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
