The present petition has been filed under Section 528 BNSS (earlier Section 482 Cr.P.C) for issuance of direction to learned Additional Sessions Judge, Ferozepur to expedite proceedings and decide revision petition bearing No.CRR/69/2025, dated 06.08.2025, which is now fixed for hearing on 22.04.2026.

Learned counsel for the petitioner submits that the petitioner has filed the afore-said revision petition challenging the order dated 04.07.2025, vide which an application moved under Section 319 Cr.P.C, for summoning Sukhminder Kaur, Jasvinder Kaur and Tejinder Singh as additional accused on the basis of the statement of the petitioner/complainant, who appeared as PW-5, was dismissed by the trial Court. In the said petition, respondent No.2 appeared and started taking adjournments for arguments and case is being adjourned on the pretext of arguments not being advanced. Now the case is fixed for 22.04.2026. Learned counsel for the petitioner, therefore, prays that the learned Additional Sessions Judge, Ferozepur may be directed to expedite the trial and decide the case.

Since a short controversy is involved in the present petition, no notice is required to be issued to respondent No.2. 4.

A perusal of the record shows that CRR-69-2025 was filed on 06.08.2025 against respondent No.2 - Beant Kaur. Notice in the said revision petition was initially issued for 19.08.2025, however, the same was not issued by the Ahlmad and notice was again ordered to be issued for 11.11.2025. The present petitioner had also moved an application for preponing the case and for early decision of the revision petition, in which notice was issued for 15.09.2025. On 15.09.2025, respondent No.2 - Beant Kaur appeared and thereafter started seeking adjournments for arguments and the case has been adjourned on several occasions on the ground that arguments have not been advanced or on account of the learned Presiding Officer being on leave. The said revision petition is now pending for consideration on 22.04.2026.

It has further been brought to the notice of this Court that respondent No.2 had earlier approached this Court by filing a petition bearing CRM-M-62380-2025 titled "Beant Kaur Grewal vs. State of Punjab" seeking directions to the learned trial Court to expedite the trial. While deciding the said petition vide order dated 10.11.2025, this Court directed the learned trial Court to expedite the trial and conclude the same at the earliest. It is the case of the petitioner that the said petition was filed without disclosing the complete facts, particularly that respondent No.2 had intentionally remained absent from the proceedings for a considerable period from the year 2018 to 2024 and was responsible for delay in the trial. It is also submitted that no notice was issued to the present petitioner in the said petition and, therefore, he could not bring the aforesaid facts to the notice of this Court.

Learned counsel for the petitioner submits that due to the aforesaid order dated 10.11.2025, the trial Court is proceeding with the trial in a hurried manner without considering that the revision petition challenging the dismissal of the application under Section 319 Cr.P.C. is pending before the learned Additional Sessions Judge. It is argued that if the trial is concluded without affording a fair opportunity to the petitioner/

-3complainant to lead evidence and without adjudication of the revision petition, the very purpose of filing the revision petition would be rendered infructuous.

In view of the limited prayer made by learned counsel for the petitioner and considering the material available on record including the observations made hereinabove, the present petition is disposed of with a direction to the learned Additional Sessions Judge, Ferozepur to expedite the proceedings in revision petition bearing No. CRR/69/2025 dated 06.08.2025 and decide the same as expeditiously as possible, preferably within a period of one month from the date of receipt of a certified copy of this order. 8.
