Mr. Saurabh Girdhar, AAG Haryana accepts notice on behalf of respondent-State of Haryana.

For the reasons recorded in the application, which is supported by an affidavit, the same is allowed and the matter is taken on board today itself.

Main case Prayer is for grant of regular bail in case FIR No.0013 dated 09.01.2022 under Sections 15(c), 27, 27-A, 29 of NDPS Act and Sections 186,307,323,353,427 IPC (Sections 465 and 472 IPC added later on) registered at P.S Sadar Fatehabad, District Fatehabad. As per allegations in the FIR, co-accused Pankaj Punia was apprehended and 52 KG 230 Grams of poppy husk was recovered from him. Said Pankaj Punia in his disclosure statement stated that he had purchased MANOJ KUMAR 2022.06.01 09:36 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner contends that the petitioner has been implicated only on the basis of disclosure statement of co-accused. Recovery has already been effected. The petitioner has no criminal past. The investigation in the case is already complete and the challan has been filed.

Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is allowed. The petitioner Jagdish is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
