IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-13378-2024 Decided on: 07.03.2025 Beena Chauhan

...Petitioner

Versus

State of Punjab and others

...Respondents

CORAM:

HON'BLE MR. JUSTICE ANOOP CHITKARA

Present:

Mr. B.S. Sidhu, Advocate for the petitioner.

Mr. Akshay Kumar, AAG, Punjab.

Mr. Lalit Singh, Advocate for respondent No.5.

**** ANOOP CHITKARA, J.

1.

Seeking legal action against respondent No.5 for furnishing false and fabricated details before this Court, the petitioner has come before this Court under Section 340 CrPC/482 CrPC.

2.

Counsel for the petitioner submits that a false concocted compromise to secure bail has been filed by respondent No.5 before this Court, which as per his knowledge was false and fabricated and he is liable for legal action. 3.

I have heard counsel for the parties and gone through the record. 4.

A perusal of the order dated 23.07.2024, vide which, a co-ordinate Bench of this Court had made the bail absolute shows that it was based on the reply filed by the State and it was explicitly mentioned in paragraph 3 of the said order that the custodial interrogation of petitioner was not required. Thus, it makes it clear that the reason for granting bail was not the compromise deed. Moreover, counsel for the petitionercomplainant was present before the Court and his presence was duly recorded along with his objection to the bail petition of respondent No. 5. So, no ground is made out to proceed further in the matter.

JYOTI 2025.03.12 15:45 I attest to the accuracy and integrity of this order/judgment.

CRM-M-13378-2024 5.

Given above, no prima facie case is made out to issue notice and present petition is dismissed. All pending applications, if any, stand disposed of. (ANOOP CHITKARA) 07.03.2025 JUDGE Jyoti-II Whether speaking/reasoned:
