******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 82 dated 19.06.2015 registered for the offence punishable under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Khamano, District Fatehgarh Sahib. Heard.

Learned counsel for the petitioner submits that the petitioner was on bail in this case and was appearing before the trial Court regularly but could not appear on 01.06.2017 due to miscommunication of date to her by her counsel. As per order dated 07.06.2017, she has already been allowed interim bail on her appearance before trial Court. CRM-M-21321-2017 -2The recovery from the petitioner is of 20grams of heroine, which is non-commercial quantity. She was already on regular bail but absented during the trial.

Keeping in view the above facts but without expressing any opinion on the merits of the case, this petition is allowed and the order dated 07.06.2017 (clarified vide order dated 09.06.2017) is made absolute subject to the condition that petitioner shall appear before the trial Court on each and every date of hearing.
