Mr. Kunwar Rajan, Advocate, for the petitioner. ***** SUDHIR MITTAL, J. (ORAL) The petitioner seeks anticipatory bail in FIR No.7, dated 20.01.2023, registered at Police Station City Kotkapura, District Faridkot, under Sections 307, 427, 324, 148 & 149 IPC.
According to the contents of the FIR, the petitioner along with his co-accused came to the shop of the complainant and attacked him with various weapons. The petitioner struck him with a spade on the head and on his right elbow. His shop was also vandalized. Learned counsel for the petitioner has submitted that a bare perusal of the FIR shows that the allegation against the petitioner is only of picking up a spade from the shop of the complainant and striking him with it. Otherwise, he had come empty handed. The nature of the injuries is not known as yet as medical opinion has not been received. Thus, it cannot be said that the petitioner has attempted to murder the complainant. In this view of the matter, he deserves to be granted anticipatory bail. 2023:PHHC:041098 CRM-M-13510-2023 --2-- The submission cannot be accepted because according to the FIR, the petitioner hit the complainant on the left side of the head above the ear with a spade and also stuck him on his right elbow. These injuries are corroborated by the MLR (Annexure P-3). Assuming that the injury on the head is declared not dangerous to life, it cannot be said that the petitioner did not intend to inflict a serious injury upon the complainant. In view of the above, the petition has no merit and is dismissed.
