(ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner in FIR No.126 dated 10.07.2018 under Section 22 of NDPS Act, 1985, Police Station Baghapurana, District Moga as non-bailable warrants have been issued against him.

Learned counsel contends that petitioner was on bail during trial, but absented on 17.01.2019. As a result thereof, he has been summoned through non-bailable warrants .

Considering single default of the petitioner, he is directed to appear before the trial court within 7 days from today and shall be released on interim bail within next 7 days. However, the trial court shall proceed against the petitioner under Section 446 Cr.P.C., without prejudice from this order. In case of non-compliance of this order, instant petition shall be deemed to have been dismissed.

Disposed of as such.
