R.P. Nagrath, J. (Oral) Prayer in the instant petition is for grant of anticipatory bail under Section 438 Cr.P.C. in FIR No. 133 dated 05.06.2015 for offences under Sections 420 and 120-B of Indian Penal Code (IPC), registered at Police Station Sadar, Ferozepur, District Ferozepur. The allegation against the petitioner is that he alongwith his co-accused Sheedo, Sonu, Sunny and Baba @ Jinder Singh deceived the complainant and his brother of an amount of ` 6,20,000/- on the promise that they would get double the amount after 3 days.
I have heard learned counsel for the petitioner and the State counsel.
In the FIR it was not stated as to when the amount was paid but in the statement of complainant under Section 161 Cr.P.C and in the statement of Roop Singh it has come out that this amount was given to accused persons about 2 months ago. However, five persons named in the FIR, namely; Baba @ Jinder Singh, Monu, Sheedo, the mother of petitioner, were arrested JITENDER KUMAR 2015.07.24 16:27 I attest to the accuracy and authenticity of this document Chandigarh

Looking into the facts and circumstances of the case, the petitioner deserves to be admitted to pre-arrest bail. Therefore, the instant application is allowed and petitioner is directed to appear before the Investigating Officer/Arresting Officer on 05.08.2015 between 11.00 a.m. to 02.00 p.m. and keep on joining investigation as and when required and cooperate with the same. Petitioner shall also abide by the restrictions contained in Section 438 (2) Cr.P.C.
In case petitioner fails to appear before the Investigating Officer on the date and time stipulated above, the concession granted vide this order shall stand vacated.
