Petitioner has filed this petition under Section 482 Cr.P.C. for direction to respondents No.2 to 4 to take strict legal action against the accused persons named in FIR No.150 dated 18.04.2013 under Sections 354, 456, 506 and 34 IPC registered at Police Station Sadar Palwal, District Palwal, as in spite of the FIR, no action till date against the accused persons has been taken by the official respondents. Notice of motion was issued in this case and learned State counsel appeared and submitted status report filed by Deputy Superintendent of Police, Palwal It is stated in the status report that after registering the FIR, the police authority investigated the matter and during the course VINEET GULATI 2015.01.30 15:30 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-24116 of 2013 -2of investigation, statements of Ganga Lal, Ex-member Panchayat, the family member of the complainant, Paltu and many other concerned persons were recorded. The said persons told that Dinesh got registered the FIR under Section 307 IPC against Jile Singh, brotherin-law of complainant, Dal Chand, father-in-law of complainant and some other persons. So, just to get this case compromised, Dal Chand made her daughter-in-law to move false complaint. It is further stated in the status report that after conducting the investigation of the matter, the complaint was found false and cancellation report was prepared and was submitted before learned Illaqa Magistrate on 12.01.2015. The copy of the interim order passed by this Court showing that cancellation report has been produced is also placed on the record.
Keeping in view the facts and circumstances of the present case and in view of the fact that cancellation report has already been filed before the Court and now the proceedings are going on before the Court of learned Addl. Chief Judicial Magistrate, Palwal and the complainant has appeared there through counsel and has stated that he wants to file protest petition, therefore, no further action is required in the present petition and the same is disposed of, accordingly.
