(Oral) The present revision petition is directed against the order dated 06.02.2020 passed by the learned Additional Sesssions Judge, Ferozepur in a case FIR No.02 dated 06.01.2019 under Sections 302 read with Section 34 of the IPC, 1860 and Sections 25, 29 and 30 of the Arms Act, registered at Police Station Mallanwala dismissing the application of the revisionist filed under Section 319 of the Cr.P.C, 1973 for summoning respondent No.1 as additional accused.
The basic ingredient to invoke the provisions of Section 319 Cr.P.C. is that the Court must be reasonable satisfied from the evidence adduced that sufficient grounds exist for summoning a person as an additional accused. However, on a perusal of the FIR in question as well as the testimony of the complainant, who stepped into the witness-box as PW-1 (Annexure P-1), this Court is satisfied that the impugned order dated 06.02.2020, is a well reasoned one and hence, the interference of this Court would not be warranted to invoke its jurisdiction under Section 401 Cr.P.C. Consequently, the instant revision petition stands dismissed.
