The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport. 2.

Learned counsel for the petitioner inter alia contends that petitioner has applied for passport vide application dated 09.01.2024. He has been implicated in FIR No. 79 of 2020. The police has filed supplementary challan wherein his name has been disclosed. The trial Court has not framed charges. 3.

Mr. Karan Singh, Central Govt. Counsel submits that the petitioner has not submitted application against reference No. 100026395237523. Unless and until, he files application, the passport authority cannot process his case. 4.

Faced with this, Mr.Hasrat Brar, Advocate seeks permission to withdraw the present petition with liberty to file proper application before passport authority.

The petition stands dismissed as withdrawn with aforesaid liberty. The passport authority, if petitioner files application, would consider the same in accordance with law.
